On Tuesday 16 January 2018. the President signed an amendment to the Restructuring Law, which adapts its provisions on state aid to the conditions required by the European Commission in the notification \"Aid scheme providing for the granting of aid to rescue and restructure small and medium-sized enterprises\".<\/p>\n

The amendment to the Restructuring Law will provide entrepreneurs who are repairing their companies with specific financial assistance from the state. The new regulations have been long awaited by restructuring advisors and companies undergoing restructuring<\/a>.<\/p>\n

Under the new law in force since 1 January 2016, restructured companies can apply for public aid, e.g. in the form of spreading debts to the state treasury (such as overdue ZUS contributions or taxes due to the tax office) into instalments. According to European Union regulations, until now, state aid for entrepreneurs could only be granted in exceptional situations, only after obtaining approval from the European Commission under the so-called notification procedure. Unfortunately, notification is a long process, taking on average up to 15 months.<\/p>\n

<\/a>Therefore, the Ministry of Justice has prepared an amendment to the restructuring law, according to which an entrepreneur can receive financial aid before initiating restructuring proceedings. This is to enable them to develop a restructuring plan or conduct business activity until the plan is implemented. Thanks to the new regulations, it will no longer be necessary to make an individual notification of such aid. The new Article 193a introduced in the Act will provide a basis for granting small and medium-sized enterprises receive restructuring aid<\/a> or temporary restructuring support.<\/p>\n

\n\u2013 This amendment was highly anticipated by companies located in during restructuring<\/a> and their managers. State creditors did not want to divide the debt into installments, justifying it with unauthorized public aid. We wtorek 16 stycznia 2018r. prezydent podpisa\u0142 nowel\u0119 ustawy Prawo restrukturyzacyjne, kt\u00f3ra dostosowuje jej przepisy dotycz\u0105ce pomocy publicznej do warunk\u00f3w wymaganych przez Komisj\u0119 Europejsk\u0105 w notyfikacji „Program pomocowy przewiduj\u0105cy udzielenie pomocy w celu ratowania i restrukturyzacji ma\u0142ych i \u015brednich przedsi\u0119biorstw”. Nowelizacja ustawy Prawo restrukturyzacyjne zapewni przedsi\u0119biorcom naprawiaj\u0105cym swoje firmy konkretn\u0105 pomoc finansow\u0105 ze strony pa\u0144stwa. Nowe przepisy by\u0142y d\u0142ugo oczekiwane przez doradc\u00f3w restrukturyzacyjnych oraz firmy w trakcie restrukturyzacji. Zgodnie z obowi\u0105zuj\u0105cym od 1 stycznia 2016r. nowym prawem, restrukturyzowane przedsi\u0119biorstwa mog\u0105 ubiega\u0107 si\u0119 o pomoc publiczn\u0105, np. w formie roz\u0142o\u017cenia na raty d\u0142ugu wobec skarbu pa\u0144stwa (takiego jak zaleg\u0142e sk\u0142adki ZUS czy podatki nale\u017cne urz\u0119dowi skarbowemu). Zgodnie z przepisami Unii Europejskiej, dot\u0105d pomoc publiczna dla przedsi\u0119biorc\u00f3w mog\u0142a by\u0107 udzielona jedynie w wyj\u0105tkowych sytuacjach, dopiero po uzyskaniu zgody Komisji Europejskiej w ramach tzw. procedury notyfikacji. Niestety, notyfikacja to d\u0142ugi proces, trwa \u015brednio nawet 15 miesi\u0119cy. Dlatego Ministerstwo Sprawiedliwo\u015bci przygotowa\u0142o nowelizacj\u0119 prawa restrukturyzacyjnego, zgodnie z kt\u00f3r\u0105 przedsi\u0119biorca mo\u017ce otrzyma\u0107 pomoc finansow\u0105 ju\u017c przed wszcz\u0119ciem post\u0119powania restrukturyzacyjnego. Ma to umo\u017cliwi\u0107 mu opracowanie planu restrukturyzacyjnego lub prowadzenie dzia\u0142alno\u015bci gospodarczej, dop\u00f3ki plan ten nie zostanie wdro\u017cony. Dzi\u0119ki nowym przepisom nie b\u0119dzie ju\u017c konieczno\u015bci dokonywania indywidualnej notyfikacji takiej pomocy. Wprowadzony w ustawie nowy art. 193a da podstaw\u0119 do udzielenia ma\u0142ym i \u015brednim przedsi\u0119biorcom pomocy na restrukturyzacj\u0119 lub tymczasowe wsparcie restrukturyzacyjne. – Ta\u00a0nowelizacja by\u0142a bardzo oczekiwana przez przedsi\u0119biorstwa, kt\u00f3re znajduj\u0105 si\u0119 w trakcie restrukturyzacji oraz ich zarz\u0105dc\u00f3w. Wierzyciele pa\u0144stwowi nie chcieli rozk\u0142ada\u0107 zad\u0142u\u017cenia na raty, uzasadniaj\u0105c to niedozwolon\u0105 pomoc\u0105 publiczn\u0105.
