As of December 1, 2021, the National Debt Register telecommunications system came into effect, and all communication in bankruptcy and restructuring proceedings takes place through it. Therefore, as a rule, bankruptcy applications should be filed electronically through the National Debt Register.
How then does one properly file a bankruptcy petition?
First of all, you need to create a Profile in National Register of Indebted Persons. Then, you should select the appropriate type of letter from the catalogue and then complete it by indicating the debtor's data and the data of their creditors. as well as the size of liabilities and due dates of these liabilities. The applicant must also indicate what assets he/she has, what his/her maintenance costs were in the six months preceding submitting an application and what his income was. A statement about the lack of negative premises for opening bankruptcy proceedings should also be submitted.
Once the application is complete, the application must be paid for. Once paid, the application can be submitted through the system.
