Submission of the application
The debtor files a consumer bankruptcy petition with the court. The petition must include detailed information about the assets, liabilities and creditors.
Consideration of the application by the court
The court assesses the validity of the application. If it is accepted, it declares consumer bankruptcy and appoints a trustee who will manage the debtor's assets.
Liquidation of assets
The trustee proceeds to sell the debtor's assets in order to satisfy the creditors' claims.
Repayment plan
If the debtor has income, the court may approve a repayment plan that provides for the repayment of part of the debts over a certain period of time, usually up to three years. At the end of the plan, unpaid debts may be written off.
Debt relief
At the end of the consumer bankruptcy process, the debtor is discharged from outstanding debts, enabling him or her to make a fresh start without debts.
