Submission of the application
The debtor files a consumer bankruptcy petition with the court. The petition must include detailed information about assets, liabilities, and creditors.
Consideration of the application by the court
The court examines the validity of the application. If the application is justified, the court declares consumer bankruptcy and appoints a trustee to manage the debtor's assets.
Liquidation of assets
The trustee begins selling the debtor's assets to satisfy the creditors' claims.
Repayment plan
If the debtor has income, the court may approve a repayment plan that provides for the repayment of a portion of the debt over a specified period, usually up to three years. At the end of the plan, the outstanding debt may be discharged.
Debt relief
Once the personal bankruptcy process is completed, the debtor is released from any outstanding liabilities, allowing him or her to make a fresh start without debt.
