Sanitation saved the Yamo

The computer company YAMO will survive through restructuring. The arrangement was supported by almost all creditors.

When, at the end of last year, we asked representatives of companies involved in the restructuring of companies about successful repairs, they found it difficult to give even one obvious example. Such a case was just boasted by PMR Restructuring, which was the manager in the sanitation of Yamo, a company distributing computer hardware and software.

Yamo działa na polskim rynku od 25 lat. Firma zaczynała z niewielkim wkładem własnym i ogromnym entuzjazmem. Najpierw sprzedawała sprzęt komputerowy, potem zmieniła profil na dystrybucję. Powodziło jej się. Jej roczny obrót sięgał 30 mln EUR. Jednak kryzys w branży komputerowej spowodował, ze wpadła w kłopoty finansowe. Zadłużenie wyniosło kilka mln zł. Firma postanowiła skorzystać z możliwości przetrwania, jaką daje prawo restrukturyzacyjne. We wrześniu 2016 r. wydział gospodarczy Sądu Rejonowego dla Wrocławia-Fabrycznej otworzył postępowanie sanacyjne Yamo. Zarządcą została kancelaria PMR Restrukturyzacje. Spis wierzytelności zatwierdzono we wrześniu 2017 r., a głosowanie nad układem odbyło się pod koniec 2018 r. Proces trwał więc niecałe trzy lata. Układ przyjęty na zgromadzeniu wierzycieli pod koniec 2018 r. Sąd Rejonowy dla Wrocławia-Fabrycznej zatwierdził w czerwcu. Nie znamy jednak jego szczegółów. Wiadomo jednak, że zawarte w nim propozycje są ściśle związane z wynikami spółki. Zapewnia on wierzyceilom regulowanie należnych im spłat w zależności od poziomu obrotów i przychodów, jakie będzie w stanie osiągać spółka.

It is worth mentioning that in the final vote, in which the consent of creditors representing two-thirds of the total claims is required, almost all of them voted in favour of the arrangement (100 per cent of the creditors in Groups I and IV, 87.33 per cent in Group II and 96.34 per cent in Group III).

Jacek Monko, CEO of Yamo, has no regrets about his decision three years ago to fix the company.
