In the event of a restructuring, the company may make changes to its legal status, which are subject to notification to the National Court Register under the applicable legislation.
Examples of information that may be visible in the KRS in the context of restructuring are changes in: the company's statutes or articles of association, the composition of the board of directors; the nature of the business, the company's address and its registered office.
Information on ongoing restructuring proceedings within the meaning of the Restructuring Law is also disclosed in the National Court Register. This information is disclosed in the sixth section under the seventh heading 'Information on restructuring proceedings, reorganisation proceedings, compulsory restructuring or placing the joint-stock company under restructuring and orderly winding-up'. Only a final decision on the execution of the arrangement provides the basis for the deletion of entries relating to the arrangement in the land and mortgage registers.
It is worth remembering that in the course of the proceedings the trader is trading under his current company with the addition of the designation "under restructuring". This solution primarily has a guarantee function vis-à-vis the debtor's potential counterparties.
