Restructuring a company without cash will not work

More than a year has passed since the new restructuring law and the amended bankruptcy law came into force. It is already known that many restructuring and sanitation proceedings will fail. One of the main reasons for this is the lack of willingness to provide financial support to companies that have the ambition - and above all the chance - to recover.

In Germany, an entrepreneur with a restructuring plan gets loans from banks on a par with those with financial problems. In our country, it is in vain to find similar examples.

When informed of problems, many actors react with downright allergic reactions.

– Economically irrational and unjustified aggressive debt collection actions by institutions financing entrepreneurs often occur restructuring. There are many examples of even directly unlawful termination of contracts and debt collection - points out Małgorzata Anisimowicz, president PMR Restructuring.

Alma Market, for example, had to deal with the termination of credit agreements by PKO BP. This meant the obligation to repay over PLN 60 million within seven days. A similar situation happened to the pharmaceutical wholesaler Intra, which, after the process had already begun, bank restructuring significantly reduced the limits of factoring, which de facto meant the seizure of money in the bank account and caused additional difficulties in the company's financial liquidity. In addition, last year, the Action company was in dispute with the banks Societe Generale and HSBC, which, despite the ongoing restructuring process, did not implement the binding agreements.
