Consumer bankruptcy - amendment to the law

Consumer bankruptcy also for those who are guilty of their situation, for people with no assets at once, with a longer time for repayment. This could be a breakthrough in debt settlement for people with no chance of settling time-barred debts and in the statistics of people taking advantage of such opportunities in Poland.

The work on the amendment to the Consumer Bankruptcy Act envisages huge improvements for people who find themselves trapped in debt, experts explain.

The three biggest changes to the Consumer Bankruptcy Act, which has been operating for only two years in a new form, is the possibility of applying for debt relief assistance by private individuals who do not run a business and who have found themselves in a bad financial situation due to their own "gross negligence", i.e. through their own fault, the extension of the debt repayment period to 7 years and a fast-track decision on granting consumer bankruptcy for people without assets, e.g. those who are supported by a family. -

– Institutionalization bankruptcy consumerism of people who are to blame for their terrible financial situation, have made mistakes, taken out loans, spent or lost money due to negligence or carelessness, is a breakthrough - says Małgorzata Anisimowicz, president of PMR Restrukturyzacje SA. - These people have been excluded so far, deprived of the possibility of constructively exiting the debt spiral and returning to society, normal life, and thus deprived of the chance to improve. We estimate that in Poland from the possibility of consumer bankruptcy should be used by up to 50,000 people per year. In Germany, the figure is 100,000.

Last year with consumer bankruptcy in Poland, 5.5 thousand people used it. This is very little compared to the real needs and popularity of such solutions throughout Europe. Consumer bankruptcy It is primarily intended to give the opportunity to return to normal life and legal work to people who, due to their debts, live on the margins, in the grey zone, do not pay taxes, do not have health insurance and are hiding from enforcement proceedings and creditors.
