Restructuring - the state will help companies

Beneficial changes to the restructuring law have come into force for entrepreneurs. They make it possible to obtain financial assistance from the state (e.g. payment of overdue taxes and ZUS in instalments) even before the start of restructuring proceedings.

Until now, state aid to companies could only be provided in exceptional situations, with the approval of the European Commission. With the new legislation, this will not be necessary.

Rescue or temporary aid support can only be provided in the form of loans. Only entrepreneurs who are not undergoing restructuring proceedings will be able to apply for it. The support is to help them regain financial liquidity and give them time to develop a recovery plan. Another form of assistance is intended to implement the plan restructuring. Such support may take the form of a loan, but also an additional payment, acquisition of shares, bonds or stocks.

ABOUT entrepreneurs involved in restructuring proceedings will be able to apply for assistance, as well as those against whom it is not carried out.

According to PMR Restructuring is a change expected by business – so far, creditors state authorities did not want to divide the debt into installments.

– This amendment was highly anticipated by companies undergoing restructuring and by their managers. State creditors did not want to divide the debt into installments, justifying it with unauthorized public aid.
