Simplified restructuring first choice in a crisis

Share this article:

Entrepreneurs, trying to adapt to a crisis and unpredictable situation, need efficient, orderly and rapid action. One solution already in place is a simplified restructuring procedure.

This is a hybrid of previous procedures, which was created with the aim of concluding an arrangement with creditors as quickly as possible and maximally simplifying the procedures, with the possibility of use by any company, regardless of its size. Thanks to the tools it brings, its use really helps in solving a number of serious problems.

In order to speed up all procedures, the simplified proceedings take place almost entirely out of court. In addition, the entrepreneur chooses a restructuring advisor on his or her own and signs a contract with him or her to supervise the proceedings. Once the agreement is concluded, the entrepreneur himself publishes a relevant notice in the Monitor Sądowy i Gospodarczy and the day of its publication automatically becomes the day of opening of the proceedings, and this without waiting for the court's decision.

– The statement was given by Małgorzata Anisimowicz, qualified restructuring advisor, president of the management board PMR Restructuring
